Remittance
Please remit all payments to ACM Technologies, ATTN: Accounts Receivable, 2535 Research Drive, Corona, CA 92882.
Returned Checks
A $20 fee will be assessed on all bounced checks or checks returned from bank as "Non-Sufficient Funds".
Invoice Discrepancy
Any invoice discrepancy must be reported to ACM Technologies within 7 days of invoice receipt (30 days for international orders).
Finance Charges
Interest will be charged on all past due amounts at the rate of 1.5% per month, plus any applicable fees incurred to collect the payment.
Jurisdiction and Venue
Buyer agrees that ACM Technologies, Inc. retains the right of Jurisdiction and Venue of the State of California. Buyer further agrees that any litigations arising from (or) out of any transaction with ACM Technologies, Inc. shall be heard in the appropriate State or Federal Court of Riverside County, California or nearest venue.
Legal Fees
In the event the purchaser breaches the terms and conditions of an invoice, and litigation is necessary to enforce ACM Technologies, Inc. rights, ACM Technologies, Inc. will be entitled to recover its reasonable attorney fees, and costs incurred in enforcing said conditions and terms.
Shortages or Damage
All shortages and damages from FedEx, UPS or other freight carriers must be reported to ACM within 48 hours. All trucking freight shortages or damages must be filed at the receiving site with the trucking carrier. If you receive product that has been visibly damaged in transit, please refuse the delivery. If you notice a shortage or damage after the carrier has left the premises, you must file a claim with the carrier according to their policies. If you need help with filing a claim, please contact ACM Customer Service.
Warranty
AirSaver System – ACM will provide technical support and assistance without charge to restore the equipment to working condition. At all times, customers should protect and maintain the equipment and avoid neglect or abuse that may damage the equipment as well as properly protect the equipment.
AirSaver Film – ACM offers a 100% money-back guarantee on all our products if they fail to perform or are found defective upon receipt. Please contact your assigned ACM Account Executive to file a claim or to process a replacement order.
Shipping Cost
We offer free ground shipping on our AirSaver products. Any expedited delivery will incur cost depending on the freight method requested.
Product Returns
Limitations and Liabilities
The ACM Technologies warranty coverage does not include freight related or accidental damage, or improper installation, storage, or abuse of the products. The ACM Technologies liability is limited to the value of the product sold. ACM Technologies will not be held liable for consequential damages to systems or internal or external components. Buyer accepts full responsibility for use of said product.
Product Returns
Prior to returning any products, customers must contact ACM Customer Service to obtain a Return Authorization Number and shipping instructions. All non-defective returns must be in resale condition and in the original packaging. Please do not mark, or write the address or Return Authorization Number on the outside of the original packaging.
Returns are only accepted within 90 days of the original invoice date. Return Authorization Numbers are valid for 30 days from the date of issue. All returns are subject to inspection by ACM Technologies on the resell condition, and a credit will be issued once the product has been received and inspected. All return freight shipping charges will be the responsibility of the customer unless it was an ACM Technologies error.
All special orders and non-stock items such as private labeled film are final and are not returnable.
Defective Merchandise
All defective returns must be pre-authorized by ACM Technologies and have a Return Authorization Number. All returns without a Return Authorization Number will be refused. Please contact your sales and customer service representative to complete a Defective Product Claim Form. ACM Technologies will issue a credit based on the usage of the film. Full credit will be issued with up to 10% usage; otherwise, partial credit will be issued based on the remaining weight of the film upon receipt and inspection of the merchandise.
